What this outcome means
The FAA studied the proposal and concluded it would not be a hazard to air navigation. A no-hazard determination is not permanent — it carries an expiration date, and if the structure is not built by then the case has to be re-filed.
The proposal, in the filer's words
"Site orientation: 9 acre project site (930 feet x 270 feet) with long side oriented north to south with 26 single family residential units where the tallest units being 37 feet. Houses are constructed of wood stud framing wood truss wood sheathing and stucco as the main exterior finish material.\nCoordinated of each corner:\nNorthwest corner: 35.991808 -115.092366\nNortheast corner: 35-991936 -115.091550\nSouthwest corner: 35.989424 -115.091115\nSoutheast corner: 35.990007 -115.090360\n\nRequesting exemption or approval:\nWe request an exemption from the requirement to file a notice of construction. Based on our assessment we believe this project is exempt from the notice requirements under 14 CFR part 77.9(e)(1).\nAs outlined in the FAA Form 7460-1 Instructions notice is not required for:\n\Any object that will be shielded by existing structures of a permanent and substantial nature or by natural terrain or topographic features of equal or greater height and will be located in the congested area of a city town or settlement where the shielded structure will not adversely affect safety in air navigation.\"\n\nJustification for exemption:\nThe proposed construction is fully shielded by existing structures and natural terrain which are significantly greater height that the proposed project. Because these shielding elements are of a permanent and substantial nature the proposed project will not create any new obstruction or adversely affect the safety of air navigation in this congested area.\n\nTo support this request we have attached an image exhibit that clearly illustrates the proposed project site in relation to the surrounding permanent structures and topography. We kindly request that the FAA grant an exemption from filing notice for this construction or alternatively provide an expedited approval based on these findings. Thank you for your time and assistance in this matter.""

Screening a structure of your own?
Check Part 77 and the tower's line of sight before you file
LOS Analyzer screens a proposed structure against FAA Part 77 surfaces and the control tower's sightline to the runway, terrain-aware, in minutes. It is a preliminary screening — not an FAA determination and not a substitute for a licensed engineering review.
