Determination of no hazardDetermined - No Hazard1 ft AGL

What this outcome means

The FAA studied the proposal and concluded it would not be a hazard to air navigation. A no-hazard determination is not permanent — it carries an expiration date, and if the structure is not built by then the case has to be re-filed.

The proposal, in the filer's words

"The proposed Mill Swamp Mitigation Bank design is built on extensive environmental assessments to guide the creation of a stable stream and floodplain system that mimics historic pre disturbance conditions. Using Maryland IRT approved methods and a modified Rosgen/floodplain restoration approach tailored to the coastal plain the design focuses on restoring natural hydrology sediment balance and ecological function. Key goals include creating a low gradient frequently connected floodplain; establishing diverse wetland habitats; reducing flow velocities; increasing channel complexity; and preserving existing forest stands while using native soils woody material and microtopography to build a resilient system. Wood structures hydric soils native vegetation and small tributaries all work together to enhance habitat promote carbon sequestration and support long-term geomorphic stability.\nWetland and stream features are designed as an integrated system where water moves freely between the channel and floodplain creating shallow emergent habitats diverse pools and hyporheic exchange. The design emphasizes reusing onsite materials avoiding stone armoring and constructing wetlands that quickly establish hydric soils and native vegetation. Coarse woody debris log structures and restored zero order channels add habitat complexity and improve ecological processes such as nutrient cycling and sediment deposition. This work supports development of a mitigation bank a large-scale ecological restoration site that generates environmental “credits” which can be purchased to offset unavoidable impacts elsewhere ensuring no net loss of natural resources while restoring high quality stream and wetland functions on the project site.\nIt should be noted that no above grade structures or open water features are proposed."

Screening a structure of your own?

Check Part 77 and the tower's line of sight before you file

LOS Analyzer screens a proposed structure against FAA Part 77 surfaces and the control tower's sightline to the runway, terrain-aware, in minutes. It is a preliminary screening — not an FAA determination and not a substitute for a licensed engineering review.
