What this outcome means

The FAA sent the case back to the filer rather than issuing a determination. This is the most common non-clean outcome and usually means something has to change or be supplied before the study can finish — not that the project was refused.

The proposal, in the filer's words

"The City of Middletown has an annual event to celebrate the 4th of July. The event takes place on July 3rd and will have fireworks from approximately 9pm to 10pm est. With cleanup happening until 2am est on the 4th. This showcases the airport to all local residents and local airport business are able to promote at the event. There is no financial impact to the airport. Along with no operation will be affected during this event. All operations were checked with ADSB. This event has been discussed by the airport commission and they approve of the event."

Screening a structure of your own?

Check Part 77 and the tower's line of sight before you file

LOS Analyzer screens a proposed structure against FAA Part 77 surfaces and the control tower's sightline to the runway, terrain-aware, in minutes. It is a preliminary screening — not an FAA determination and not a substitute for a licensed engineering review.
