What this outcome means
The FAA studied the proposal and concluded it would not be a hazard to air navigation. A no-hazard determination is not permanent — it carries an expiration date, and if the structure is not built by then the case has to be re-filed.
The proposal, in the filer's words
"A Determination of No Hazard To Air Navigation was previously received for the new Stevens Milk Plant project on March 27 2024 under 2024-AGL-2595-OE and a subsequent Extension was approved on August 22 2025. Construction is slated to begin with crane erection on February 15 2026. The max operating height of the crane will be 370' which is required in order to erect building precast and place equipment inside the building footprint. \n\nConstruction Equipment Location Height and Operation Radius\nThe site has been assigned the following address by Stevens County: 26724 470th Avenue Morris MN 56267.\n\nThe closest edge of the crane’s operating radius is 24944.968’ (4.724 miles) southeast of the nearest runway located at Morris Regional Airport (MOX). \n\nThe 200’ Crawler Crane will operate at a maximum height of 370’ within a 700’ radius of the approximate building center point as illustrated by the attached exhibit. The crane will navigate within this radius to assemble the precast building walls and place equipment within the buildings during construction.\n\nConstruction Operations\nDue to the size of the project the construction window for employment of the crane will be from February 15 2026 when the crane erection will begin to December 31 2026 when building erection and equipment placement is anticipated to be completed. \n\nThe crane is to be used during daylight operating hours only. It is anticipated this will be 5:30 a.m. to 9 p.m. during seasonally extended daylight hours (spring summer fall) and from 7 a.m. to 5 p.m. during shortened winter daylight hours. The boom of the crane will be flagged and equipped with a beacon. The crane boom will be lowered at night after operating hours and will not exceed the 370’ operating height listed."

Check Part 77 and the tower's line of sight before you file
LOS Analyzer screens a proposed structure against FAA Part 77 surfaces and the control tower's sightline to the runway, terrain-aware, in minutes. It is a preliminary screening — not an FAA determination and not a substitute for a licensed engineering review.
